Introduction and General – The use of The Actionable Group and Actionable Research, Inc.’s services for marketing research consulting, survey delivery, data collection, business and operations consulting, participation in the Actionable Web panel, and general use of this Web Site (the “Service”) is intended only for Users eighteen (18) years of age and older. Users of the Service under the age of 18 are required to receive the consent of a parent or guardian. Our Clients (those who commission our Services, “Clients”) also approve our standard Agreement for Services (“Services Agreement”). In any case where the provisions of this document conflict with the provisions contained in the Services Agreement, the Services Agreement will prevail.

Notice to EU Individuals: this Privacy Statement and its enumerated policies are intended to comply with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (the “General Data Protection Regulation” or “GDPR”) and provide appropriate protection and care with respect to the treatment of your user information in accordance with the GDPR.

 

Use of Gathered Information from Visitors and Survey Respondents – Actionable Research, Inc. will conduct surveys in connection with this Web Site or through our delivery of the Service in which we may ask you to provide basic personal information (e.g. e-mail address) and demographic information (e.g. zip code) and, from time to time, other product and service preference information. We shall use the information collected from such surveys to improve the features, functionality, appearance, and content of this site, or to recommend improvements to our customer’s sites, products or services. Actionable Research, Inc. will never use this information for marketing or promotional activities, nor will it be sold to any third parties in any form that allows for the individual identification of any user in any way. Also, should any client that hires Actionable Research, Inc. wish the same to collect data for uses which may identify any User individually, Actionable Research, Inc. will clearly post this possibility at the beginning of any survey delivered. Users are not required to participate in any survey delivered, and may “opt out” of participation in any survey.

 

Survey Respondent Data and Compliance with Health Insurance Portability and Accountability Act of 1996 (“HIPAA” or “The Act”)

Privacy and Security Rules – Actionable Research, Inc. generally avoids the handling of electronic patient health information (e-phi) in their surveys. Should Actionable Research Inc. handle any e-phi within any Survey fielded on behalf of any Client, Actionable Research, Inc. certifies that its handling of the e-phi is compliant with HIPPA Privacy and Security Rules. This includes Privacy Provisions as well as Administrative Safeguards, Physical Safeguards and Technical Safeguards. As outlined in the Act for Covered Entities:

* Covered entities must reasonably limit uses and disclosures to the minimum necessary to accomplish their intended purpose.
* Covered entities must have procedures in place to limit who can view and access e-phi as well as implement training programs for employees about how to protect your health information.

Use of Gathered User Information from Actionable Panel Members – Members of the Actionable Web Panel (“Members”) will be required to provide certain, potentially extensive, personal information (e.g. name, e-mail address, telephone number, company name, etc.) and demographic and preference information (e.g. title, business type, business function, zip code, age, income level, pastime activities, etc.). This information shall be stored by Actionable Research, Inc. and will be used in unaggregated form only by Actionable Research, Inc., and only to identify groups of Members for participation in particular commissioned studies. The identities and all other information provided by Member about themselves will not be shared with any entity outside of Actionable Research, Inc., except in various aggregated forms (“Aggregated Forms”). These aggregated forms will never reveal the individual name or any other information that could lead to the identification of individual Members of the Panel. Aggregated Forms include but are not limited to, listed numbers of users in segments based on demographic, preference and other information to show the Panel size and capabilities, and to identify trends and group consumer behavior. Information gathered from Members will not be used by Actionable Research, Inc. to send members marketing and promotional notices for anyone’s products or services, other than to notify Members of studies and surveys in which they are requested to participate (see next paragraph). You may elect to be included on other specific mailing lists Actionable Research, Inc. makes available, however, by notifying Actionable Research, Inc. as set forth in the last paragraph of this document. The inclusion on any mailing list or service will not occur by default in any case, and is also revocable by Member at anytime upon notice to Actionable Research, Inc.

 

Actionable Panel Notices and Membership – Actionable Research, Inc. must inform Members of new survey opportunities (the “Survey Notice”), as participation in surveys is an integral function of the Members. Survey Notices will be sent to Members via E-mail, informing them of our desire for their participation in new surveys that fit their demographic, market segment and/or interests. Actionable Research, Inc. will compensate Members in some fashion as set forth in the Survey Notice. Members may, at any time, discontinue their membership to the Actionable Panel by sending us notification as set forth in the last section of this document. Any Data or Information gathered during the time any User was a Member is still available for use by Actionable Research, Inc. and its clients, subject to the Terms and Conditions set forth in the previous paragraph of this document.

 

Site Traffic Tracking – When you use the Site or the Service, Actionable Research, Inc. automatically tracks certain information about you. This information includes your domain name and IP address, your browser version, your operating system, the URL you came from, the pages you visit within the Site, and the URL to which you go upon leaving the Site. Actionable Research, Inc. uses this information, in an aggregate form only, to monitor Site performance, utilization of features and services, traffic trends, and browser versions.

 

Use of Cookies – Actionable Research, Inc. uses web browser “cookies” on a limited basis, and only to store certain “state” information such as your unique User ID and your session identifiers. Since cookies are stored in human-readable form, Actionable Research, Inc. does not store other User data such as passwords, preferences, etc. in cookie files. Actionable Research, Inc. will not read cookies from your cookie file other than those placed there through your web browser’s interaction with the Site.

 

Linked Sites – The Site may include links to other web sites (the “Linked Sites”). Except as expressly stated herein, Actionable Research, Inc. shall not share personally identifiable information about Users with the operators of such Linked Sites, but may provide aggregate information regarding Users to such operators. While Actionable Research, Inc. will not provide information which a) identifies individual users, or b) allows for operators to deduce individual users identities, Actionable Research, Inc. is not responsible for the privacy practices or the content of the Linked Sites and hereby expressly disclaims all responsibility and liability which may arise therefrom.

 

Customer Promotion Messages – Companies or individuals who use Actionable Research, Inc.’s services (individually known as a “Client”) may from time to time be sent brief messages outlining upcoming events and new services provided by Actionable Research, Inc. The Client may opt out of receiving these notices by contacting Actionable Research, Inc. in a manner consistent with the last paragraph of this document.

 

Security – While Actionable Research, Inc. strives to protect its Users’ personal information and privacy and takes reasonable action to prevent unauthorized access to data stored on Actionable Research, Inc.’s systems, we cannot guarantee the security of any information you disclose online. You acknowledge that you are aware of security and privacy limitations, including but not limited to: (1) the limitation of security, privacy and authentication measures and features in this system; and (2) that data or information on the Service may be subject to eavesdropping, sniffing, spoofing, forgery, spamming, “impostering”, tampering, breaking passwords, harassment, fraud, electronic trespassing, hacking, nuking, system contamination (including, without limitation, viruses, worms and Trojan horses) causing unauthorized, damaging or harmful access and/or retrieval of information and data on your computer, may be subject to other security or privacy hazards or may not reach its destination or may reach an erroneous address or recipient.

 

European Union Users – Users in the European Union fully understand and unambiguously consent to the collection and processing of their personal information in the United States.

 

Disclosure of Information Pursuant to Valid Legal Process – Actionable Research, Inc. shall, pursuant to valid legal process such as a search warrant, subpoena, or court order, allow access to all available and relevant information in order to comply with such process and protect Actionable Research, Inc.’s rights and property. If warranted, Actionable Research, Inc. may also allow access to this information in special emergencies where physical safety is at risk. Users’ IP addresses may also be traced by Actionable Research, Inc. and disclosed for these purposes.

In addition, if you have opted out of receiving certain information, you may elect to resume receiving such communications, newsletters or marketing and promotional notices.
